Subdivision appeal heard

BAR HARBOR — The Appeals Board held a public hearing Tuesday for an administrative appeal of code enforcement officer Angela Chamberlain’s denial earlier this year of a building permit for a duplex residence at 704 State Highway 3.

The meeting began at 7 p.m. and went late into the evening, planning director Bob Osborne said. Owners of land abutting the lot in question were notified of the hearing by mail, but none spoke for or against the appeal. The discussion was between the Board of Appeals, the board’s attorney, applicant Scott Allen, his attorney, his engineer, Chamberlain and an attorney representing the town staff, Osborne said.

Allen and his wife, Pamela, got approval several years ago for a subdivision to include five two-unit buildings. “The town’s ordinance has a requirement that a subdivision has to be started and be substantially complete within a certain time frame,” Osborne said. “It was a detailed discussion, getting into the nitty gritty of what the ordinance says about when a subdivision is substantially complete.”

No decision was reached at the meeting.
