BANGOR — Charges have been dismissed against a Southwest Harbor driver involved in a May 2014 crash on the Seal Cove Road in Acadia National Park in preparation for a new charge related to the accident.
Justin Bent, who was 24 at the time of the single-vehicle crash, was facing federal charges of operating while under the influence, operating a motor vehicle without due care and the destruction or disturbance of trees, plants and other natural resources.
A passenger was seriously injured in the crash and was taken by LifeFlight helicopter to a Bangor hospital for treatment.
U.S. Magistrate Judge John Nivison on Jan. 21 granted the federal government’s motion to dismiss the case without prejudice. According to court records, the request for dismissal is a precursor to charging Bent with a new offense, operating while under the influence causing serious bodily injury, which is a felony. Prosecutors claim they decided to file the new charge after learning the extent of the passenger’s injuries.
